Emigration Act 1983 - Amendments

Suggesting of Committee Constituted - Orders issued.

ORDER
 

The conditions of job seekers who fall prey to illegal recruitment, the torture faced by several housemaids, in foreign countries, the incarceration of innocent migrants for alleged drug trafficking, etc., have been engaging the attention of the Government. The recent incidents of illegal recruitment to Iraq have further underlined the need for a re-look at the Recruitment policies. The State Government has since reviewed the situation on the basis of representations received by it and is convinced about the need to weed out all malpractices in this area.

Presently recruitments to foreign countries are done as per the Recruitment Act 1983. This being a Central Act, framing of rules doesn't come under the state Government's purview. In this regard, one of the important suggestions is about the pressing need for an amendment of the Act of 1983. The Emigration Rules 1983 (as amended in 1987, 1989, 1996 and 2002) and the working of those provisions in the backdrop of complaints and to adapt in to the recruitments of the present times. In view of the implications of laws - national, international and the impact of other laws. It is necessary to have a considered opinion of experts in different fields.

Therefore, the Government is pleased to constitute a committee with the following members:

The Mandate of the Committee shall be to examine :-

a. Recruitment procedure and system and the existing practices. The deficiencies and the remedial measures.

b. The safeguards for the emigrants as regards the work and service conditions

c. Role of the various agencies entrusted with the implementation of the Act. The deficiencies noticed and the desirability of involving State agencies or local authorities.

d. Amendments to be carried out in the Act to make it more effective.
e. Any other incidental and ancillary matters.

 

The committee shall furnish the final report within 3 months from the date of this order.

The Committee may meet in New Delhi. The Non Official members may perform their duties on a honorary basis. However, a sitting fee of Rs. 1000/- per person per sitting will be disbursed by M/S. ROOTS-NRK Development initiative. The expenditure for organizing Committee meeting and other incidentals shall also be met by M/S. ROOTs, the field agency of the Department of NORKA.
